Shariah-compliant real estate transactions are structured to avoid riba (interest), which is prohibited under Islamic law. Yes. In Ontario, a real estate lawyer is legally required for any property transaction involving a mortgage. Even in cash transactions, a lawyer handles the title search and title insurance, the transfer of ownership at the Land Registry Office, mortgage documentation, closing adjustments, and the exchange of funds between parties. Your real estate agent negotiates the price and transaction terms — only a lawyer can handle the legal transfer of title and protect your legal interests at closing.
On a purchase closing, your real estate lawyer reviews the title search and identifies any encumbrances, easements, or liens registered against the property. They arrange title insurance, coordinate mortgage funds from your lender, calculate closing adjustments (property taxes, utilities, condo fees), pay the purchase price to the seller's lawyer, register the transfer of ownership and your mortgage at the Land Registry Office, and provide you with a reporting letter confirming the transaction. On a sale closing, the process is reversed — your lawyer receives funds, discharges your existing mortgage, and transfers net proceeds to you.

The Non-Resident Speculation Tax (NRST) is a tax applicable to foreign nationals and certain foreign-controlled entities purchasing residential property in Ontario. The current NRST rate applies to the purchase price of qualifying residential properties and is payable on closing. Certain exemptions may apply — including for protected persons, nominees under provincial immigration programs, and international students or foreign workers meeting specific criteria. Non-resident and foreign buyers should obtain legal advice before entering into any Agreement of Purchase and Sale in Ontario. We advise foreign buyers on NRST obligations, available exemptions, and withholding requirements under federal and provincial law.
A title search is a review of the registered history of a property in Ontario's electronic land registry system (Teraview). It identifies registered encumbrances, liens, easements, restrictive covenants, rights-of-way, executions, and other claims that could affect your ownership rights. Your real estate lawyer conducts the title search before closing to confirm the seller has clear, marketable title and to identify any issues requiring resolution before you take possession. Issues found in a title search must typically be addressed or insured against before a lender will advance mortgage funds and before a lawyer can close the transaction.
If a title issue is discovered before closing, your lawyer will advise you on the nature and severity of the issue. Depending on the type of defect, the seller may be required to resolve it before closing as a condition of the Agreement of Purchase and Sale, the issue may be resolved through a title insurance policy, or the matter may require negotiation or legal action. If a title issue cannot be resolved, you may have the right to terminate the transaction and recover your deposit. Title insurance also provides protection for certain title defects discovered after closing that were not apparent at the time of the title search.
